BetterBot, Inc. (“BetterBot” “we,” “us,” or “our”) provides chatbot and AI-powered automation services through www.BetterBot.com (the “Site”). We created this privacy policy and terms of use (the “Privacy Policy”) to govern data collection, usage, and liability protections for BetterBot’s customers and their consumers (“End Users”). This Privacy Policy relates to the information collection and use practices of BetterBot in connection with our online services (the “Services”). By visiting our Site and/or using our Services, or by permitting your child to use our Services, you as the End User agrees to the terms of this Privacy Policy. If you do not agree, do not use our Services.
We strive to educate parents and children about how to appropriately safeguard their privacy when using our Services. While our website is primarily directed toward users above the age of 13, we are committed to complying with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), which requires us to inform parents and legal guardians about our information collection and use practices. COPPA also requires that we obtain parental consent before we allow children under the age of 13 to access and/or use our Services. We urge kids to check with their parents before entering information through our Site and/or Services, and we recommend that parents discuss with their kids restrictions regarding the online release of Personal Information (as defined below) to anyone they don’t know. Our website provides accessible mechanisms allowing children to control the public availability of their information. We take significant steps to ensure that these controls are easy to use and understood by children. Parents have the right to review, edit, or request the deletion of their child's information at any time for any reason. 1. Information We Collect.
(a) Personal Information. We do not collect any personal information from you unless you voluntarily provide it to us. When you sign up to become a user of the Site (a “User”), you will be asked to provide us with certain personal information, such as your first name, last name, and email address. In this Privacy Policy, we refer to this information as “Personal Information.” Other than the online contact information required to obtain parental consent, we do not collect any Personal Information from Users under the age of 13 unless the User’s parent or legal guardian has first provided us with consent for that User to use the Services and disclose Personal Information to us. If you are a User under the age of 13, please do not send any Personal Information to us if we have not obtained prior consent from your parent or guardian. If we learn we have collected Personal Information from a User under the age of 13 without parental consent, or if we learn a User under the age of 13 has provided us Personal Information beyond what we request from him or her, we will delete that information as quickly as possible. If you believe that a User under the age of 13 may have provided us Personal Information in violation of this Privacy Policy, please contact us at contact@betterbot.com. If you sign in through SSO, you are authorizing BetterBot to collect, store, and use, in accordance with this Privacy Policy, any and all information that you agreed that the SSO Provider would provide to BetterBot through Application Programming Interface (“API”). Such information may include, without limitation, your first and last name, username, profile picture, headline, unique identifier, access token, and e-mail address. We do not receive or store your passwords for your SSO Provider.
(b) Data Usage. Like most websites, we use automatic data collection technology when you visit the Site to record information that identifies your computer, to track your use of our Site, and to collect certain basic information about you and your surfing habits. This information includes information about your operating system, your IP addresses, browser type and language, referring and exit pages and URLs, keywords, date and time, amount of time spent on particular pages, what sections of a website you visit, and similar information concerning your use of the Site and the Services (the “Usage Information”). Any data collected from children under the age of 13 is used solely to provide requested services and communication and is not used for advertising purposes.
(c) Data Collection Policy. BetterBot securely stores your data at AWS by leveraging S3, EBS volumes and database storage and implements industry-standard security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal information. We will retain your data for 12 months or as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Once your data is no longer needed for the purposes for which it was collected, or upon your request, we will securely delete or anonymize your data in a manner that ensures it cannot be reconstructed or interpreted.
(d) Cookies Policy. We collect Usage Information by using various types of cookies and data trackers to enhance user experience and provide relevant services. These may include (1) session cookies, which are used for session management and security purposes; (2) analytics cookies, which include cookies from Google Analytics in order to analyze website traffic to improve services; and (3) advertising cookies, which include those from Google Ads in order to help us deliver targeted advertisements and measure effectiveness; and (4) other data trackers that are used to improve the functionality of our products and services to provide an optimal user experience. Users may opt out of cookie and data tracking at any time. However, please note that certain features or services may be limited or unavailable if cookies are disabled. Most internet browsers provide functionality that allows users to disable or limit the acceptance of cookies. Depending on the capabilities of the browser software, users may configure their settings to block all cookies, to reject new cookies, or to prompt for approval before accepting each cookie. Please note, however, that removing or disabling cookies may require users to re-enter certain preferences upon subsequent visits, and certain Services or features may operate with limited functionality or may be unavailable. Our website uses Google Analytics for traffic analysis and Google Ads for advertising. These services collect and use data as per their privacy policies. We do not control these third-party practices but provide transparency about their usage. 2. How We Use Your Information.
We may use your Personal Information and Usage Information in a manner that is consistent with this Privacy Policy and the context of our relationship with you. We will use your Personal Information and Usage Information collected through the Site for the following purposes:
(a) To identify you when you sign in to your account;
(b) To respond to your requests and to provide you with the Services;
(c) To respond to your inquiries and contact you about changes to the Site and/or the Services;
(d) To send you notices (for example, in the form of e-mails, mailings, and the like) regarding products or services you are receiving, and for billing and collection purposes;

We do not disclose or sell your Personal Information to third parties for their direct marketing purposes.
We, like many businesses, sometimes hire other companies to perform certain business-related functions. Examples include mailing information, maintaining databases, hosting services, and processing payments. When we employ another company to perform a function of this nature, we provide them with the minimum information that they need to perform their specific function, which may include Personal Information.
If we or all or substantially all of our assets are acquired, we expect that the information that we have collected, including Personal Information, would be transferred along with our other business assets.

We take commercially reasonable steps to protect the Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.
5. Accessing and Modifying Account Information.
You may update the information that is stored in your user account by visiting https://betterbot.com/contact/ or by e-mailing us at contact@betterbot.com. We strive to help parents ensure that their kids have a safe experience using our Services. Parents or legal guardians can review any Personal Information collected about their child under 13 years of age, have this information deleted, request that there be no further collection or use of their child’s Personal Information, and/or allow for our collection and use of their child’s Personal Information while withholding consent for us to disclose it to third parties. We take steps to verify the identity of anyone requesting information about a child and to ensure that the person is in fact the child’s parent or legal guardian.
6. Opt-Out.
If you wish to stop receiving promotional e-mails, you may do so by visiting https://betterbot.com/contact/ or by e-mailing support@betterbot.com. You may also choose to unsubscribe from our emails by following the instructions in the bottom of the email. We do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.
7. Links.
The Site may contain content, services, advertising and other materials that link to websites operated by third parties. We have no control over those other sites, and this Privacy Policy does not apply to them. Please refer to the privacy policies of those sites for more information on how the operators of those sites collect and use your Personal Information.
8. Limitation of Liability
(a) No Warranties on AI-Generated Content. BetterBot’s AI-powered Services generate automated responses. We do not guarantee accuracy, legality, or appropriateness. End Users rely on AI-generated content at their own risk.
(b) No Liability for End Users’ Actions. BetterBot is not liable for how End Users interact with or interpret chatbot responses. Any transactions, decisions, or reliance on AI-generated content are solely between the End User and the BetterBot customer who implemented the chatbot.
(c) Third-Party Services. BetterBot integrates with third-party tools but does not control their policies or practices. Customers using third-party integrations assume all associated risks.
(d) Indemnification. Customers agree to indemnify, defend, and hold BetterBot harmless from claims arising out of their End Users’ use of our Services. End Users acknowledge that any disputes regarding information provided by the chatbot must be resolved directly with the BetterBot customer, not BetterBot.
(e) Liability Cap. BetterBot’s total liability shall not exceed the fees paid by the customer in the twelve (12) months preceding the claim.
9. Disclaimers & Warranties.
BetterBot provides the Services “as-is” without warranties of any kind. We do not guarantee uptime, accuracy, or performance. BetterBot is not responsible for any content, statements, or representations made by its customers or End Users using its Services.
10. Permitted Use of BetterBot’s Services
End Users may use BetterBot’s chatbots and automation tools solely for lawful purposes. Users may NOT use BetterBot to (a) submit false, misleading, or malicious information; (b) violate any laws, including intellectual property, privacy, or consumer protection laws; (c) engage in harassment, discrimination, or unethical behavior; or (d) attempt unauthorized access to BetterBot systems. Violation of these terms may result in suspension or termination of access.
11. Important Notice to Users outside the U.S.
The Site and the Services are operated in the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By providing us with any information through the Site or the Services, you consent to this transfer.
12. Governing Law and Dispute Resolution.
This Privacy Policy is governed by the laws of the State of Georgia. Any disputes must be resolved through binding arbitration in the State of Georgia, County of Fulton.
13. Changes to This Privacy Policy.
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time and will post any changes on the Site as soon as they go into effect. By accessing the Site or using the Services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy on a regular basis.
